After Signing a Lease in Korea: Reports, Address and Fixed Date

After signing a residential lease in Korea, keep three tasks separate: the housing lease report, the address record for your own registration status, and fixed-date certification of the contract (확정일자). A receipt for one task does not, by itself, prove that the other two are finished.

The useful starting point is two dates: when the lease was concluded and when you actually moved. A reportable lease normally has a 30-day reporting period from the contract date; a registered foreign resident's change-of-address rule uses the move-in date instead. Do not postpone the paperwork until you collect a new card or assume that “everything was handled at the office” without checking the results.

1. Know which result you are trying to obtain

TaskWhat starts the checkResult to verify
Housing lease report (주택 임대차 계약 신고)Whether the contract's amount, location and type make it reportable; usually 30 days from conclusion. The actual report status and receipt for this contract, not just a saved form.
Address updateFor a foreigner already registered under the Immigration Control Act, a move starts the 15-day period in Article 36. The overseas-Korean domestic-residence route has a different 14-day rule. The completed address record for the applicable registration route and exact new address.
Fixed date (확정일자)Whether certification has already been assigned through a completed lease report with the contract submitted, or a separate application is needed. The fixed-date entry or number for the matching contract.

I would keep these as three lines on one checklist. Even if one office helps with several tasks, the evidence still needs to identify what was actually processed. A reporting deadline is not advice to wait until its last day; the timing of housing-protection requirements can matter earlier.

2. Check whether your lease must be reported

The current reporting threshold is a deposit over KRW 60 million or monthly rent over KRW 300,000. Either condition is enough for the amount test. Exactly KRW 60 million and exactly KRW 300,000 do not exceed those thresholds; changing the rent to KRW 310,000 does. These are illustrative comparisons, not a decision on a particular contract.

Location matters as well. Article 4-3 of the Enforcement Decree lists special self-governing cities and provinces, cities, autonomous districts, and counties within metropolitan cities or Gyeonggi-do. Do not reduce that to “all counties are excluded.” Ask the authority for the property's actual address if the administrative category is unclear. A renewal that only extends the term without changing either the deposit or rent is excluded by that provision; a changed-rent renewal is not automatically excluded.

RTMS lists online reporting and an in-person route at the community service centre responsible for the leased property. Under the joint-reporting rules, one party may submit a lease contract signed or sealed by both landlord and tenant. Refusal by the other party, an absent written contract and proxy reporting need their own requirements checked. Foreign nationality is not a reason to assume that an otherwise reportable residential lease needs no report.

Start at the official RTMS service guide. Opening the portal does not establish that your identity method will work online. If it does not, ask the property's reporting office about its supported in-person route and documents rather than using another person's authentication. If the landlord says the report is done, obtain and check its actual receipt before submitting a duplicate.

3. Use the address-reporting rule for your registration status

Already registered foreign nationals: Article 36 of the Immigration Control Act requires the change of place of stay to be reported within 15 days of moving. The law lists the new locality's city/county/district or eup/myeon/dong office, or the immigration office responsible for that address. The official foreign-student housing guidance also points to HiKorea for online reporting. Check the current application requirements and successful processing, not only an appointment or a draft submission.

Overseas Koreans using a domestic-residence report: Article 6(2) of the Overseas Koreans Act has a 14-day change-reporting rule. Do not apply the 15-day rule to that different record merely because both applicants hold a card.

Not yet registered, or waiting for a physical card: do not calculate a new deadline simply from the day a card is delivered. First registration, the registered address, a later move and production of the physical card are different matters. Ask the immigration authority which record already exists and how your actual move should be handled; the already-registered rule above does not resolve every first-registration case.

Have the exact address, unit details, residence documentation and complete lease available when checking the requirements. If you are not the named tenant, ask which accommodation evidence is required for your situation. Do not post a residence card, registration number or signed lease in a public comment.

4. Check the fixed date instead of ordering it twice

A fixed date is an official certification associated with the lease document, not simply the date typed or handwritten into the contract. Article 6-5(3) of the Real Estate Transaction Reporting Act treats it as assigned when the relevant lease report has been received as completed and the lease contract was submitted. A form saved on a phone, or a report without the required contract, should not be treated as the same completed result.

Look for the fixed-date entry or number on the applicable report receipt or contract record, and match the parties, property, deposit, rent and term. If it is unclear, ask the office that handled the report before making a second application. Conversely, obtaining a fixed date separately does not by itself prove the lease-report obligation was fulfilled.

If a separate fixed-date application is needed, check the community centre or registry office's current requirements, or the Internet Registry Office (IROS). Ask about the complete original contract, identification, authentication and receiving office before travelling. This guide does not claim that the whole online transaction is available in English or that every foreign resident can use its authentication route.

5. Do not read one certificate as a deposit guarantee

Article 88-2(2) of the Immigration Control Act provides that foreigner registration and a change-of-place-of-stay report substitute for resident registration and a move-in report. That distinction is important: a foreign resident should not be told that a Korean citizen's ordinary resident-registration procedure is the only relevant route.

Under Article 3, protection against third parties begins the day after both delivery of the home and the applicable registration requirement are met. Article 3-2(2) also requires a fixed date for repayment priority, subject to its conditions. A fixed date alone does not establish that all those requirements are met or that every won of a deposit will be recovered. Existing rights, the particular property and any dispute need a separate document-based review. This is a general procedural guide, not an assessment of an individual lease, priority ranking or insurance eligibility.

I would ask the office one practical question before leaving: Which of these three tasks is complete, and which document shows it? Keep the matching results with the signed contract. If an address or contract term is wrong, ask the handling authority how to correct it; do not alter an official receipt yourself.

The Korean question asks the office to identify the completed lease report, fixed date and applicable address update. Provide personal details only through its verified private channel.
